Equality Caucus Condemns Court Decision on PrEP Medication & ACA Preventive Services

March 30, 2023

WASHINGTON, DC Today, the Congressional Equality Caucus condemns the decision in Braidwood Management v. Becerra blocking a requirement that health insurance plans cover a range of preventive health services without a copay, including pre-exposure prophylactic (PrEP) to prevent HIV. LGBTQI+ people are disproportionately impacted by the HIV epidemic, and PrEP is a critical tool in the fight against the disease.

"Today's extreme decision means insurance companies are no longer required to cover a range of preventive health services, including PrEP, for free. This puts the health and wellbeing of Americans — especially LGBTQI+ Americans — at risk," said Equality Caucus Chair Mark Pocan (WI-02). "Today's ruling threatens the progress we have made under the ACA, including our progress to end the HIV epidemic and address the health disparities that LGBTQI+ people, people of color, women, and other marginalized communities face. This decision will cost lives if not swiftly stayed and reversed. I urge insurance companies to continue providing these services free of charge so patients do not have to worry about losing access to these critical services."
